Peer calls for Government to repeal the European Communities Act 1972 rather than go “cap in hand to Brussels for permission to leave”


The independent Labour Peer, Lord Stoddart of Swindon, has welcomed the result of the referendum but has some strong words of advice for the Government about how to take Britain out of the EU.

Lord Stoddart said: “What wonderful people the British are to have resisted all the threats, the denigration of their country by their own rulers, big business, big bureaucracy and intervention by arrogant foreign leaders. Despite all this intimidation they still voted to get their country back. We must now ensure that they are not betrayed again by their leaders.

“The first step in this should be for the Government to introduce a bill to repeal the European Communities Act 1972 and all its amendments. This would give it the authority to negotiate our exit from the EU. While this Act remains in force, we have to go on handing over vast sums of money to the EU and we are still subject to its demands.

“The preoccupation with Article 50 of the European Treaty is a red herring and requires the Government to go cap in hand to Brussels for permission to leave. We should seize the initiative and start the process of getting our country back now, not wait months for an interminable Conservative Party leadership contest, followed by several years while we await permission from Brussels to leave. The Government has the authority of the people to act and it should do so, not sit on its hands.”

Lord Stoddart said: “At the moment, Westminster seems to be playing second fiddle to the European Council. I understand that Mr Cameron is going to write to the President of the Council to set out his proposed negotiations before bringing them to Parliament. I call upon the Prime Minister to lay his proposals before Parliament in the right and proper manner and to do so before he presents them to the Council.

“I would remind Mr Cameron that he is the Prime Minister of a Government and sovereign Parliament at Westminster and he is subject to the traditional obligation of any Prime Minister, namely to consult Parliament first about this or, for that matter, any other major Governmental policy decision.

“Therefore, I have submitted a written question in the House of Lords, asking if the Prime Minister is going to consult Parliament, before going cap in hand to Brussels.”

Andrea Leadsom has already mooted the point that she may initiate the repeal of the 1972 Act. In fact, parts of it will have to be repealed in any case in order to initiate Article 50.

At last a peer that is saying something I have advocated for the last 10 years, but that is the state of play, many of the peers either refuse to acknowledge or don’t know that this 1972 European act is an illegal act, at the time it was introduced, prior and subsequently no parliament, no government and certainly no MP’s have ever had the legal power or authority under the Magna Carta ( applicable at the time ), loosely term as our constitution, to cede power or sovereignty to any foreign entity of government, Power comes with the sovereignty that… Read more »

I don’t know the noble Lord but he is saying exactly what I said on 24th June. We could be out by now. This is the way out of the EU with least cost and hassle. The Agenda 50 EU law is a jumbled convoluted minefield of legal hurdles, pitfalls and frankly, tricks.WE DO NOT NEED TO AND WE SHOULD NOT LEAVE THE EU USING AGENDA 50.WE SHOULD USE OUR OWN ACT, THE EUROPEAN COMMUNITIES ACT OF 1972.

Lord Stoddart is such a wonderful genuine man. He has tried several times to push government to repeal the European Communities Act 1972 prior to activating Article 50 but, as usual, government do not listen. They do need their heads banging together.

Lord Stoddart is a wonderful gentleman. He is genuine. I emailed him on subject of our referendum and he mailed a reply to me, (which is more than can be said for Gove and Boris Johnson!) and he pretty well said same thing as well as stating he was pleased that brexit won the referendum. He is so helpful but government is not really listening. They need their hands banging together

I don’t believe Cameron will put his proposals forward I think he will pass the buck as he wants to remain in a favourable light with the EU after he told them he believed Britain would vote to remain. Thank you we the people want this bill presented before parliment and as far as is applicable enforced. We want the leave vote respected. We are also aware of the Lisbon treaty and the deadline written their in. Hence why we have also demanded article50 be invoked.

Speaks good sense to me, David Cameron should be enacting this now and not waiting for a new leader. He should grow some balls and carry out the mandate from a democratic vote from the people. This would also give out to the rest of the world that we are confident and in control. Sounds a good idea to me. Article 50 could see us tied up for years, especially as they want to punish us to deter others from leaving
