TAKING BACK CONTROL: Repeal Bill set to AXE EU laws within HOURS of triggering Article 50

BRITAIN will begin to take back control of its laws from Brussels this week, within hours of Theresa May triggering Article 50.

The Government will publish a White Paper on the Great Repeal Bill which will set out the steps required to end the supremacy of EU law and give Britain back its sovereignty and independence.The White Paper will be published less than 24 hours after the Prime Minister triggers Article 50 on Wednesday, which will kick-start the historic process of Britain leaving the EU.

It will lay out how control will be returned to Parliament, introducing temporary new powers to “correct the statute book to ensure a smooth and orderly exit”.A Government source said: “Next week will mark a defining moment in this country’s history, when the Prime Minister invokes Article 50 and opens the way for formal negotiations to leave the EU and build a truly global Britain. But a strong, sovereign country needs control of its own laws. That, more than anything else, was what drove the referendum result – a desire for the country to be in control of its own destiny.

“So next week we will get on with the job and set out the steps we will take to ensure control of our laws lies in London, Edinburgh, Cardiff and Belfast.”

The source added: “This momentum demonstrates the Government’s commitment to getting on with delivering a smooth and orderly EU exit.”The Great Repeal Bill is intended to give MPs the chance to abandon Brussels diktats while choosing the laws they want to keep, such as those protecting workers’ rights.

The Bill will repeal the 1972 European Communities Act, which gives EU law supremacy over domestic legislation.

The source said: “A Great Repeal Bill will formally remove it from the statute book on exit day and make the UK a sovereign and independent country once again.”

It means on the day of Brexit all European laws will be simultaneously converted into domestic law, which MPs can then amend, repeal or improve after appropriate parliamentary debate and scrutiny.

“This will give businesses and workers maximum possible certainty as the UK leaves the European Union and existing workers’ legal rights will continue to be guaranteed in law,” the source said.“It will also help ensure a smooth and orderly exit from the EU.”

I agree with what you say in principle Peter but I believe there is still a problem with these legal arguments. The constitutional ones would no doubt come down to how our Supreme Court decided them and we have seen before a 3:8 majority against how we would have judged the Geena Davis case. The trade ones would also be decided by international courts whose judges’ opinions will not be grounded in “pure” legal certainty. Indeed who are these judges, who appointed them, how independent are they, what programmes and prejudices do they bring to their respective benches? The ECJ… Read more »

Peter, Thank you for responding with a detailed and interesting argument. I agree with much of what you write and certainly with the background. However it is clear that there is great fragility in the EU and increasing opposition to Brussels inflexibility from those who have to listen to voters or risk being ejected from government, unlike the Eurocrats. One such is Mark Rutte who defeated Geert Wilders by adopting a good deal of his program, or at least his rhetoric. If Macron and Schultz win their elections it won’t help us of course, at least in the short term.… Read more »

Could you update my recent comment please? The EU was designed to prevent dangerous populists taking control of the Continent and instead imposed a powerful elite to guide us, with the inevitable result: a self-assured, self-interested and self-perpetuating, government disconnected from its citizens interests in pursuit of an irrelevant ideology. Pader is right that the Brussels elite is threatening to harm its own with its approach to Brexit negotiations but their ideology matters more to them and the damage will occur outside their guilded offices. The EU was designed to prevent dangerous populists taking control of the Continent and instead imposed a powerful elite to guide us, with the inevitable result: a self-assured, self-interested and self-perpetuating, government disconnected from its citizens’ interests in pursuit of an irrelevant ideology. We are right to be leaving but we should try to do so as smoothly as possible to minimise the enormous disruption that will occur because the EU reaches so deeply into how our country runs.
